TERMS AND CONDITIONS

INTRODUCTION

The company, MADAGASCAR EXPLORER, declares that it has the licenses and permits to carry out its activities as Tour Operator including sales of package tours; all inclusive tourists services and has the civil liability insurance, under the Malagasy law.

TECHNICAL INFORMATIONS

The company promotes its activities through various marketing support such as brochures, leaflet… in which at least the following information is mentioned: details of the licenses and permits; Civil Liability Insurance policy, validity period of the information given, exchange rate.

– C.L. INSURANCE: N° 605.938 (ARO Company)

PRICES, ADJUSTMENTS

Rates have been worked out on the basis of the current prices given to the company by Malagasy service suppliers.

However, the unstable economic situation of the country may results in abrupt changes of goods and services such as the fuel cost and/ or the foreign exchange rates to the local currency MGA. In this case, our suppliers are sometimes obliged to adjust their prices without any delays. Consequently, our prices will also be adjusted according to the price difference; and the updated offer will be sent to the clients in a short period of time.

Rates (in Euro) include, according to the service required, the hotel tax (Vignette Touristique), the Municipal tax (Taxe communal) and the VAT and they are periodically re-calculated according to the cost of services and the exchange rate (Ariary/ Euro).

Any currency changes relating to the relevant exchange rate (see paragraph 2) or to the fuel cost will be immediately applicable to all current bookings, after having given prompt notification.

DEPOSIT AND PAYMENT

  • Deposit: 25 % upon confirmation of booking.
  • Payment: 30 days prior the arrival dates the latest for Individuals / 45 days before the start of services for groups.
  • If a booking is requested less than 45 days prior to the arrival date and confirmed, full payment is required before booking is processed.

IMPORTANT NOTE: If your payment is not credited within the prescribed booking period, then you will be automatically deleted to our system.

CANCELLATIONS BY THE TRAVELER – PENALTIES

If the client cancels some or all portions of the bookings, then cancellation fees will be applied.

  • 33 days prior the start of all services: 25%
  • 23 days prior the start of all services: 80%
  • 10 days prior the start of all services: 100%

COMPLAINTS – REFUNDS

Complaints and/or refund requests for services provided must be received by the Company within 20 days from the end of the stay in Madagascar. Each request should at least give the following information: name; email-address; Refunds are made in the case of the non-execution or partial execution of services, due to the Company’s fault and are limited to the value of the services which were not executed or part of them, plus any extra cost the client has assumed, when proof provided. Refunds are not provided for any unlike events that are not under the Company’s control, airline services and any other cases in which the Company’s responsibility is not involved. In addition to that, the Company cannot be held responsible for non-execution or partial execution of services provides by the suppliers; we already select the most reliable suppliers and they are asked to fulfill their commitments. However for any incidence, all refund requests regarding the supplier’s responsibility will be forward to them who will then be asked to make the refund according to the terms of their insurance contracts.

COMPANY'S RESPONSIBILITY & LIABILITY

The Company is covered by an appropriate Civil Liability insurance that protects the clients for any third party damages.

In addition we will not be responsible for any situation that are out of our control such as damages caused by a third party this for instance is the service suppliers or the airline companies.

TRAVEL INSURANCE

We strongly recommend that all travelers obtain travel and health insurance before flying to Madagascar and taking any of our tours.

PASSPORT AND VISAS

Upon arrival in Madagascar, client must have a valid passport for six months beyond the duration of the trip and a visa which can be obtained upon arrival in Madagascar.

IMPORTANT NOTE: only one (01) month tourist visa with single entry can be provided at the international airport of Madagascar.

Client must also abide by normal prudence and diligence rules and to the specific ones in force in Madagascar, in addition to all the information supplied by the Company. Client will also have to answer to all damages that the Company should be subjected to because of Client’s acts.

COMPANY ASSISTANCE OBLIGATIONS

The Company must provide assistance to the Client as per professional diligence criteria, only in reference to the obligations related to the execution of the package.

HOTEL CATEGORY

Irrespective of the hotel classification, the Company reserves the right to supply its own description of the hotels in Madagascar, so as to allow an assessment and consequent acceptance of the hotel by the Client.

CHILD PROTECTION

Malagasy law provides for imprisonment for crimes of prostitution and child pornography.

The present General Conditions will be applied automatically, in order to regulate the arrangements between MADAGASCAR EXPLORER and the Client.
